This Privacy Policy applies to the Silverlight websites, related mobile applications and services (the “Services”). These services  are made available to you and are operated by Nomad Ventures Limited (“Silverlight”, “we”, or “us”) with its address at A9, 7/F, On Shing Industrial Building, 2-16 Wo Liu Hang Road, Fo Tan, Hong Kong.

Account & Profile & Usage Information

Silverlight collects basic account information from you, such as your name, email address, username and password that helps us secure your account and provide you access to our Services.

Profile, activity and usage information is collected about you when you choose to upload an activity (including date, time and geo-location information and your speed, pace and elevation), or purchase a physical product and generally use our Services.

We use your contact information in order to respond to your support requests and Feedback.

Location Information

We collect and process location information when you sign up for and use our Services. We do not track your device location while you are not using Silverlight, but in order to provide Silverlight’s core Services, it is necessary for us to track your device location while you use Silverlight and track an activity.

Payment Information

When you make a payment on Silverlight, you may provide payment information such as your payment card or other payment details. We use Payment Card Industry compliant third-party payment services and we do not store your credit card information.

Third-Party Accounts

Silverlight allows you to sign up and log in to the Services using accounts you create with third-party products and services, such as Facebook or Google (collectively, “Third-Party Accounts”). If you access the Services with Third-Party Accounts we will collect information that you have agreed to make available such as your name, email address, profile information and preferences. This information is collected by the Third-Party Account provider and is provided to Silverlight under their privacy policies. We receive and store certain types of technological information when you use our Services such as our mobile application, websites, our emails, and our online advertisements.   • Earn Effort tokens based on your activities

Your information, including parts of your profile, username will be shared on Silverlight so that you may be able to participate in our Services, for example to show your place on a leaderboard. Certain information (e.g., your username, and some profile information) is also available to non-members on the web. Your precise location information, such as where you run or hike, may also be shared on Silverlight.

We use the information we collect to protect members, enforce our Terms & Conditionsand promote safety. For example, we find and remove content that violates our terms, such as hate speech or spam, as well as suspend or terminate accounts that share such content.

To improve our Services

We also use the information we collect to analyze, develop and improve the Services. To do this, Silverlight may use third-party analytics providers to gain insights into how our Services are used and to help us improve the Services.

To communicate with you

We use the information we collect to provide support in response to your requests and comments.

We may also use the information we collect to market and promote the Services, activities and events on Silverlight, and other commercial products or services. This includes marketing and push communications, where you have not opted out of receiving such messages and notifications.

This website currently uses the third parties Stripe and Paypal to process payments. Stripe accepts payments through various credit cards, including Visa, MasterCard, American Express and Discover, as detailed on the applicable payment screen. Paypal accepts payments through your Paypal account. These transactions are subject to the respective terms & service agreements of these third parties. We recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

How do we protect your information?

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with an AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all legal requirements and implement additional generally accepted industry standards.

How do you get my consent?

Account Deletion

You may ask us to delete your account or send a request for account deletion from our settings. After you make a deletion request, we permanently and irreversibly delete your personal data from our systems, including backups. Once deleted, your data, including your account, activities and place on leaderboards cannot be reinstated. Following your deletion of your account, it may take up to 90 days to delete your personal information and system logs from our systems. Additionally, we may retain information where deletion requests are made to comply with the law and take other actions permitted by law.

Retention of Information

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted. In addition, you can delete some items of information (e.g., profile information).

Following your deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations, enforce the Terms & Conditionsand take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

Payments

The price for all items available for purchase will be displayed to you when accessing the Services. Silverlight is using the third parties like Stripe and Paypal to process payments. Stripe accepts payments through various credit cards, including Visa, MasterCard, American Express and Discover, as detailed on the applicable payment screen. Paypal accepts payments through your Paypal account. If you provide your payment information, you authorize us and certain third party service providers, payment card networks and payment processors to receive, store and encrypt your payment information. These transactions are subject to the respective terms & service agreements of these third parties.

If your payment provider determines that there are fraudulent charges on your account resulting from use of your Payment Method at the Services, please contact us immediately via hello@silverlight.store

Currency

Our default store currency is USD. However you may choose to pay via your local currency in EUR, GBP, AUD, NZD, CAD, SGD, HKD, DKK, SEK or NOK.

Taxes

You will be solely responsible to pay any and all sales, use, value-added and other taxes, duties, and assessments (except taxes on our net income) now or hereafter claimed or imposed by any governmental authority (collectively, the “Taxes”) associated with your use of the Services. Except for income taxes levied on us, you: (a) will pay or reimburse us for all national, federal, state, local or other taxes and assessments of any jurisdiction, including value added taxes and taxes as required by international tax treaties, customs or other import or export taxes, and amounts levied in lieu thereof based on charges set, services performed or payments made hereunder, as are now or hereafter may be imposed under the authority of any national, state, local or any other taxing jurisdiction; and (b) will not be entitled to deduct the amount of any such taxes, duties or assessments from payments made to us pursuant to these Terms.

If your shipping address is in the European Union, we will charge VAT (value-added tax) at the time of checkout for orders of physical products valued at 150 EUR or less or equivalent in your local currency and forward these value-added taxed to the relevant tax authorities via the Import One Stop Shop (IOSS) scheme. If your physical product order is delivered to the European Union it will not incur any additional value-added tax liabilities when being imported into the European Union.

Shipping

We currently offer free worldwide standard shipping to all our customers for physical products. Standard Shipping orders should usually arrive within 5-12 working days for most countries. Holidays, special occasions (e.g. before Christmas) or extreme weather events may delay shipping times. For the US, EU, Australia and New Zealand express shipping for an additional fee is available. The express shipping time is 3-6 working days.

If delivery of the products to you is delayed by an event outside our control (e.g. because of postal/courier delays, logistics or bad weather), we’ll let you know as soon as possible. If there is a risk of substantial delay, you can contact us to cancel your order and we’ll refund you for any products you’ve paid for but not received.

If no one is able to take delivery and the products cannot be posted through your letterbox, the courier will notify you of the delivery attempt and tell you how to rearrange delivery or collection of the products.

If you’re not satisfied with any item, simply return it to us at any time for an exchange or refund of the purchase price, no questions asked.

Our guarantee applies to Silverlight products that do not meet expectations in terms of durability, comfort and fit, however, there are things that are not covered by our guarantee:

  • Damage due to heat, fire etc. or any other damage not caused by wearing the socks.
  • Dog chews or other animal bites, damage due to intentional actions or force majeure.
  • Any losses after delivery and receipt of the products.
  • Purchase of additional pairs with intention to return (e.g. ordering multiple sizes and returning the ones that don’t fit)

We try to make our products as durable as possible (not just for our customers, but also for sustainability), but any clothing product will eventually wear out and needs to be replaced. If you feel like your Silverlight product(s) met or exceeded the expected lifetime of the product and you got a fair use out of what you paid, we encourage you to place a new order.

Refunds, Returns, Exchanges & Cancellations

Orders for physical products you submit online may not be cancelled online immediately. Online orders may be cancelled by contacting us by email via hello@silverlight.store. Orders that are already processed may not be cancelled, and you may need to wait until you receive the item in order to return it. If you want to return or exchange an item please contact us at hello@silverlight.store. Returns & exchanges due to any problems with our physical products are covered by our free return shipping policy. Refund requests received within 90 days of purchase will be issued to the original form of payment when available. Refunds processed beyond 90 days will be issued via Silverlight store credit for future purchases.

Non-Fungible Tokens (NFTs)

You acknowledge and agree that there are inherent risks associated with NFTs and that such risks extend to your use of the Services. These risks include, but are not limited to, the failure of hardware, software or internet connections, the risk of malicious software introduction and the risk of unauthorized access to your Account or NFT Wallets. It is your responsibility to familiarize yourself with the risks involved with NFTs, their protocols and networks. Use of the Services does not remove these risks. Silverlight is not responsible for any communication failures, disruptions, errors, distortions or delays when using the Services, however they may be caused.

You acknowledge that an NFT has no inherent value nor does Silverlight or any third party promise that an NFT has or will ever have any specific value. Transactions can take time to be confirmed and may, in some cases, not be completed. For example, if you initiate a withdrawal Transaction to settle NFTs to an External Wallet and you provide an incorrect or incomplete address, the withdrawn NFTs may be lost and may not be recoverable. If you attempt to send or receive NFTs that are not supported by the Services, the NFTs may be lost entirely and may not be recoverable. In no event will Silverlight be liable to you or to any third party for any of the foregoing.

If the Services post a dollar value in association with a specific NFT in your Hosted Wallet, such posting shall not constitute a representation as to the actual or projected value of such asset. Instead, such posting constitutes either: (i) the potential value attributed to the NFT by another User; or (ii) Third Party Content published to the Site or Account for your general information only, and you should not rely on such posting for any financial decision. You agree that it is your responsibility to independently ascertain the value of your NFTs, without relying on the Services. Silverlight is not, itself, offering to purchase or sell any NFTs from you or to you under this Agreement. You agree that you shall not make any claim against Silverlight that alleges, in whole or in part, that any NFT has anything more than nominal value.

You understand and accept that there are also inherent risks associated with using any NFTs network, including Approved Networks. These risks include, but are not limited to, unanticipated changes to the network protocol or unknown vulnerabilities which may include or result in underlying technology attacks. Other possible risks may include forks or rollbacks of NFTs, networks, or blockchains. Silverlight has no control over any Approved Networks and will not be responsible for any loss you suffer when you transact via any Approved Network.

Reviews & Feedback

We welcome your reviews, comments, feedback, suggestions, and other communications regarding the Services and the information and services we make available through the Services (collectively, “Feedback”). If you provide Feedback, you hereby grant to Silverlight a worldwide, non-exclusive, transferable, assignable, sub-licensable, perpetual, irrevocable, royalty-free license to copy, distribute, create derivative works of, publicly display and perform and otherwise exploit such Feedback and to use, make, have made, sell, offer for sale, import and export products and services based on such Feedback. For this reason, we ask that you not send Silverlight any Feedback that you do not wish to license to us as set forth above.

Feedback may be subject to moderation. We only publish Feedback that does not contain content which we believe to be offensive, including language that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or racially, ethically, or otherwise objectionable. Making feedback publicly available is under the sole discretion of Silverlight.

NFTS ARE INTANGIBLE DIGITAL ASSETS THAT EXIST ONLY BY VIRTUE OF THE OWNERSHIP RECORD MAINTAINED IN THE FLOW NETWORK. ALL SMART CONTRACTS ARE CONDUCTED AND OCCUR ON THE DECENTRALIZED LEDGER WITHIN THE FLOW NETWORK. WE HAVE NO CONTROL OVER AND MAKE NO GUARANTEES OR PROMISES WITH RESPECT TO SMART CONTRACTS.

WE ARE NOT RESPONSIBLE FOR LOSSES DUE TO BLOCKCHAINS OR ANY OTHER FEATURES OF THE FLOW NETWORK, OR ANY ELECTRONIC WALLET, INCLUDING BUT NOT LIMITED TO LATE REPORT BY DEVELOPERS OR REPRESENTATIVES (OR NO REPORT AT ALL) OF ANY ISSUES WITH THE BLOCKCHAIN SUPPORTING THE FLOW NETWORK, INCLUDING FORKS, TECHNICAL NODE ISSUES, OR ANY OTHER ISSUES HAVING FUND LOSSES AS A RESULT.

YOU EXPRESSLY AGREE TO RELEASE SILVERLIGHT, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, AGENTS, REPRESENTATIVES, EMPLOYEES, PARTNERS AND LICENSORS (THE “RELEASED PARTIES”) FROM ANY AND ALL LIABILITY IN CONNECTION WITH YOUR ACTIVITIES AND/OR USE OF THE SILVERLIGHT WEBSITES, MOBILE APPLICATIONS, CONTENT, SERVICES OR PRODUCTS, AND PROMISE NOT TO SUE THE RELEASED PARTIES FOR ANY CLAIMS, ACTIONS, INJURIES, DAMAGES, OR LOSSES ASSOCIATED WITH SUCH USE. YOU ALSO AGREE THAT IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH (a) YOUR USE OR MISUSE OF THE SERVICES, (b) YOUR USE OR MISUSE OF EQUIPMENT OR PROGRAMS CREATED OR LICENSED BY SILVERLIGHT, (c) YOUR DEALINGS WITH THIRD-PARTY SERVICE PROVIDERS OR ADVERTISERS AVAILABLE THROUGH THE SERVICES, (d) ANY DELAY OR INABILITY TO USE THE SERVICES EXPERIENCED BY YOU, OR (e) ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES OR CONTENT OBTAINED THROUGH THE SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF SILVERLIGHT HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES.

Dispute Resolution

The parties shall use their best efforts to settle any dispute, claim, question, or disagreement directly through good-faith negotiations, which shall be a precondition to either party initiating a lawsuit or arbitration. Except for disputes relating to the Silverlight’s intellectual property (such as trademarks, trade dress, domain names, trade secrets, copyrights, and patents) or if you opt out of this agreement to arbitrate, all claims arising out of or relating to this Agreement and your use of the Services shall be finally settled by binding arbitration administered by the Hong Kong International Arbitration Centre in accordance with its provisions and procedures for consumer-related disputes, excluding any rules or procedures governing or permitting class actions. The arbitrator, and not any court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to this Agreement, including, but not limited to, any claim that all or any part of this Agreement is void or voidable. The arbitrator shall be empowered to grant whatever relief would be available in a court; provided, however, that the arbitrator will not have authority to award damages, remedies, or awards that conflict with this Agreement. The arbitrator’s award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction. The place of arbitration shall be in Hong Kong at HKIAC. There shall only be one arbitrator. The languages to be used in the arbitral proceedings shall be English.

NOTICE: BOTH YOU AND SILVERLIGHT ARE AGREEING TO HAVE ALL DISPUTES, CLAIMS OR CONTROVERSIES ARISING OUT OF OR RELATING TO THIS AGREEMENT DECIDED BY NEUTRAL BINDING ARBITRATION AND ARE GIVING UP ANY RIGHTS IT MIGHT POSSESS TO HAVE THOSE MATTERS LITIGATED IN A COURT OR JURY TRIAL. BY AGREEING TO THIS AGREEMENT, BOTH YOU AND SILVERLIGHT ARE GIVING UP THEIR RESPECTIVE JUDICIAL RIGHTS TO DISCOVERY AND APPEAL EXCEPT TO THE EXTENT THAT THEY ARE SPECIFICALLY PROVIDED FOR UNDER THIS AGREEMENT. IF ANY PARTY REFUSES TO SUBMIT TO ARBITRATION AFTER AGREEING TO THIS PROVISION, THAT PARTY MAY BE COMPELLED TO ARBITRATE UNDER FEDERAL OR PROVINCIAL LAW. BOTH YOU AND SILVERLIGHT CONFIRM THEIR AGREEMENT TO THIS ARBITRATION PROVISION IS VOLUNTARY.

General

You agree that no joint venture, partnership, joint controllership, employment or agency relationship exists between you and Silverlight as a result of the Terms or your use of the Services. The Terms and Privacy Policyconstitute the entire agreement between you and Silverlight with respect to your use of the Services. The failure of Silverlight to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision. If any provision of the Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should give effect to the parties’ intentions as reflected in the provision, and the other provisions of the Terms remain in full force and effect. You may not assign, delegate or otherwise transfer your account or your obligations under these Terms without the prior written consent of Silverlight. Silverlight has the right, in its sole discretion, to transfer or assign all or any part of its rights under these Terms and will have the right to delegate or use third party contractors to fulfill its duties and obligations under these Terms and in connection with the Services. Silverlight’s notice to you via email, regular mail or notices, posts, or links on the Services shall constitute acceptable notice to you under the Terms. A printed version of the Terms and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to the Terms to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. Section titles and headings in the Terms are for convenience only and have no legal or contractual effect. Any rights not expressly granted herein are reserved.

Termination

You agree that Stilverlight may, under certain serious circumstances and without prior notice, immediately suspend or terminate your account and/or access to the Services. Cause for such suspension or termination shall include, but not be limited to, (a) breaches or violations of the Terms or other incorporated agreements, policies or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Services (or any portion thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) nonpayment of any fees owed by you in connection with the Services. Termination of your account may include (x) removal of access to all offerings within the Services, (y) deletion of your information, files and Content associated with your account, and (z) barring of further use of the Services. Further, you agree that all suspensions or terminations for cause shall be made in Silverlight’s sole discretion and that Silverlight shall not be liable to you or any third party for any suspension or termination of your account or access to the Services.

Updates

Certain provisions of the Terms may be supplemented or superseded by expressly designated legal notices or terms located on particular pages on the Services. Silverlight reserves the right to update the Terms at any time and for any reason in its sole discretion. Silverlight will notify you of any material changes to the Terms or to any service or other features of the Services. By continuing to access or use the Services after we have provided you with notice of a modification, you are agreeing to be bound by the modified Terms. If the modified Terms are not acceptable to you, your only recourse is to cease using the Services.

Silverlight and its third party service providers may make improvements and/or changes in the Services, products, services, mobile applications, features, programs, and prices described at any time and for any reason in its sole discretion. The mobile application may download and install upgrades, updates and additional features in order to improve, enhance, and further develop the Services. Silverlight reserves the right at any time to modify or discontinue, temporarily or permanently, the Services or any portion thereof with or without notice. You agree that Silverlight shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Services.
